OIR Issues Statement on the Successful Dismissal of Lawsuit Following the Passage of House Bill 747

Oct 14, 2021

Tallahassee, Fla. - Today, Florida Insurance Commissioner David Altmaier issued a statement of support for the dismissal of a lawsuit following the passage of House Bill 747 in 2020.

"House Bill 747 provides important protections for consumers accessing critical lifesaving air ambulance services. The successful dismissal of this lawsuit will ensure consumers are protected from extraordinary out-of-pocket expenses at a time when they need help most.

I want to thank the bill sponsors Representative Jayer Williamson and Senator Manny Diaz for their leadership on the bill and Governor Ron DeSantis for his continued commitment to protecting Florida insurance consumers."

Background:

Following the passage of House Bill 747, a lawsuit was filed against the Office of Insurance Regulation to prohibit the law's enforcement. The Order granting the motion to dismiss the lawsuit is available  here.

House Bill 747 was passed by the House on February 20, 2020, and subsequently the Senate on March 12, 2020. The bill was approved by Governor DeSantis on September 18, 2020. It is codified into sections 627.42397 and 641.514, Florida Statutes.
